Tribal Temporary Assistance for Needy Families (TANF) - Fraud Policy
 
The Tribal TANF and JTP Programs also have regulations regarding fraud as well as a developed work.

Fraud is the intentional action, inaction, or statement made by an individual for the purpose of obtaining benefits to which he or she is not entitled.

An intentional program violation is an action taken by an individual that intentionally misrepresents, conceals, or withholds a material fact for the purpose of establishing or maintaining a family's eligibility for TANF benefits or for increasing or preventing a reduction in the amount of the family's benefit. Public assistance fraud is frequently referred to as an intentional program violation (IPV). An IPV may occur with or without a dollar loss.

If program fraud is suspected the TANF Case Manager will conduct an investigation to determine the level of the penalty which may warrant one or all of the following:
  • Recoupment
  • Court ordered restitution; or
  • Criminal prosecution.
  • Data will be compiled which may include interviewing employers, unemployment staff, case workers, college staff, GED and/or HSED instructors, and any one else and/or any other program to gather facts.
